These Terms of Service (“Terms”) govern your access to and use of https://baxarn.com/ (the “Website”) and any purchase from Baxarn (“Store”, “we”, “us”, or “our”). By accessing the Website and/or placing an order, you agree to be legally bound by these Terms. If you do not agree, please do not use our Website or services.

1. Overview & Made-to-Order Nature

Baxarn operates as a made-to-order retailer. Each product is manufactured specifically for you after your order is confirmed.

  • Production start: Production begins only after payment is successfully authorized/verified.
  • Variations: Because items are made-to-order, minor variations in color, placement, alignment, scale, or texture may occur. Such variations are normal and are not considered defects.
  • Processing time: Made-to-order items typically require 2–5 business days to process before shipping (excluding weekends and public holidays).

2. Eligibility & Account Use

By using this Website, you represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms. You agree not to use our products or services for any illegal or unauthorized purpose, and not to violate any applicable laws.

3. Pricing, Currency, Taxes & Payment Security

  • Currency: Prices are displayed in USD (or the currency shown at checkout) and may change without notice.
  • Taxes & duties: You are responsible for any applicable taxes, customs duties, or import fees unless stated otherwise at checkout.
  • Payment processing: We use secure third-party payment processors (including Stripe) to process transactions. We do not store your full card details on our servers.
  • Accurate information: You agree to provide current, complete, and accurate billing and shipping information for all purchases.

4. Order Acceptance & Errors

We reserve the right to refuse, cancel, or limit any order at our discretion (including for suspected fraud, pricing errors, or production constraints). If we cancel an order after you have been charged, we will issue a refund to the original payment method.

5. Changes & Cancellations (Made-to-Order)

Because items are made-to-order, requests to change or cancel an order must be made as soon as possible by emailing contact@baxarn.com.

  • Cancellations: You may request cancellation before production starts. If production has not started, you will receive a full refund (no cancellation fee).
  • Once production has started, cancellation may not be possible.

6. Product Information & Website Accuracy

We strive to display product descriptions and images as accurately as possible. However, we do not guarantee that your device's display of colors will be perfectly accurate. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Website is inaccurate at any time without prior notice.

7. Shipping, Delivery Estimates & Risk

  • Estimates: Any delivery dates provided are estimates and are not guaranteed.
  • Carrier delays: Delays caused by carriers, customs, weather, or other events outside our control may occur.
  • Risk of loss/title: To the maximum extent permitted by law, title and risk of loss transfer to you once the order is handed over to the shipping carrier. We will reasonably assist with carrier investigations when possible.

8. Returns, Refunds & Replacements

Due to the made-to-order nature of our inventory, we do not offer returns or exchanges for subjective reasons such as change of mind or incorrect size selection by the customer.

We offer refunds or replacements only for items that arrive damaged, defective, or if the wrong item was shipped, in accordance with our Return & Refund Policy.

Claim timeframe: Proof of damage/defect (photos/videos) and your order number must be sent to contact@baxarn.com within 7 days of delivery.

9. Intellectual Property

All content on this Website, including text, graphics, logos, images, designs, and software, is the property of Baxarn PTE. LTD. and is protected by applicable copyright and trademark laws. Unauthorized use is prohibited.

10. Limitation of Liability

To the maximum extent permitted by law, Baxarn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website, services, or products. Our total liability for any claim related to an order shall not exceed the amount you paid for the order giving rise to the claim, except where prohibited by law.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to These Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates on the Website. It is your responsibility to check this page periodically for changes.
